Writ of Certiorari to the Supreme Court of the United States of America

  Petitioner/Complainant  - Edward N Schwarz, presidential candidate: Youth International Party

Respondent(s) - US Federal Government

Complaint - Dereliction of Duty by 'Oath of Office' holders to 'Defend and Uphold the Constitution' in regards Article 2 section 1; office of presidency to be that of  'natural born citizen' - Failure to comply.

Remedy - Judicial review of candidates`08 pertinent records to determine actual physical place of birth in compliance with 'natural born citizen' criterion with subsequent awarding of electoral congress votes to only the qualified presidential candidate/s in accordance with constitutional provisions.

My Argument

To date, every US president has been born on US incorporated soil in compliance with Article 2 section 1 of our Constitution. The public/media debate by Philip J Berg Esq. raising the question of Sen. Obama's 'natural born' status is unprecedented in the annuls of American jurisprudence. Mr. Berg has pointed out that the Bureau of Vital Statistics [BVS] Certificate of Live Birth that Sen. Obama has placed on his campaign web site to qualify his candidacy is an incomplete record. The field marked 'Place' is not an indication of the child's place of birth, but is instead the locality of the BVS office issuing the certificate.

                Literally, a child bearing person traveling out of state or country of residence, giving birth there, upon return to place of residency applies to the local BVS office for its certificate of birth with the documents required by the BVS for such an application. However that subsequent BVS issued certificate does not reflect the child's place of birth, but rather the 'place'/locality of the BVS issuing office for that area and time of the child's residency. In order to determine a persons actual eligibility as 'natural born citizen' under article 2 section 1 criterion 'born on US incorporated soil', one must review those documents that were required by the BVS in the first place, such as a hospital's birth certificate which obviously shows the child's place of birth by the very nature of the hospitals physical address.

  - McCain is also not a natural born citizen.

 In July 2008 Gabriel Chin of the University of Arizona 's James E. Rogers College of Law published...

     ... the Supreme Court held that 'unincorporated territories' were not part of the United States for constitutional purposes. Accordingly, many decisions hold that persons born in unincorporated territories are not Fourteenth Amendment citizens. The Tribe-Olson Opinion also suggests that Senator McCain obtained citizenship by statute. However, the only statute in effect in 1936 did not cover the Canal Zone . Recognizing the gap, in 1937, Congress passed a citizenship law applicable only to the Canal Zone , granting Senator McCain citizenship, but eleven months too late for him to be a citizen at birth. Because Senator John McCain was not a citizen at birth, he is not a 'natural born Citizen' and thus is not 'eligible to the Office of President' under the Constitution.  http://mccainfactcheck.com/facts/11/343544.shtml  (Besides, Sen. McCain's mother would not have suffered herself to give birth in some swamp land area, mosquito infested, malaria ridden, 1930's era military infirmary. She went off base/zone to some Panamanian city civilian hospital to birth her son.)

My Standing

As a legitimate presidential candidate, FEC listed and Manhattan newspaper reported (City Hall News), it is my contention and challenge that no other presidential candidate `08, other than myself, can produce legitimate documentation showing themselves to be 'natural born citizen'.

 In accordance with the law and original intent of our founding fathers, 'divine Providence [intervention]'[1], I win the office of the presidency of the United States by default on Just One[2] vote: My own.    $In God We Trust $[3]
